Terms of Service

By creating a TrackWon account or using the TrackWon platform, you agree to be bound by these Terms of Service ("Terms"). These Terms form a legally binding agreement between you and Cloudhubibi FZE, a company registered in the Dubai World Trade Centre (DWTC) free zone, UAE, trading as TrackWon.

If you are using TrackWon on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms. In that case, "you" refers to both you individually and your organisation.

If you do not agree to these Terms, do not use TrackWon.

TrackWon is a signal-driven sales intelligence platform. It connects to your Google Workspace (Gmail and Google Calendar), reads your commercial email and calendar activity, converts that activity into structured signals, scores deal momentum, and surfaces a recommended next action (Priority Move) per active commercial relationship (Journey).

TrackWon is a tool to assist sales professionals in prioritising their activities. It does not make decisions on your behalf. All actions taken as a result of TrackWon's outputs are your responsibility.

You are responsible for maintaining the security of your TrackWon account credentials. You must not share your login credentials with any person outside your organisation.

You must notify us immediately at support@trackwon.com if you become aware of any unauthorised access to your account.

You are responsible for all activity that occurs under your account. TrackWon is not liable for any loss resulting from unauthorised access to your account where you failed to take reasonable steps to protect your credentials.

You must provide accurate and complete information when creating your account and keep that information up to date.

To use TrackWon's core features you must connect your Google Workspace account via Google OAuth. By connecting your Google account you:

• Confirm that you have authority to connect that Google account to TrackWon.
• Grant TrackWon permission to read Gmail messages in your INBOX and SENT folders for the purpose of detecting commercial email activity.
• Grant TrackWon permission to read Google Calendar events for the purpose of detecting commercial meeting activity.
• Acknowledge that TrackWon will process this data as described in our Privacy Policy.

You can disconnect your Google account from TrackWon at any time from within the product's Integrations settings or from your Google Account permissions page. Disconnecting immediately revokes TrackWon's access to your Google account and stops all data syncing.

TrackWon's access to your Google account is governed by Google's terms and policies in addition to these Terms. If Google's policies change in a way that affects TrackWon's ability to provide the service, we will notify you as soon as reasonably practicable.

You agree to use TrackWon only for lawful purposes and in accordance with these Terms. You must not:

• Use TrackWon to access, monitor, or collect data about individuals without their knowledge or consent where required by applicable law.
• Use TrackWon in a way that violates any applicable law or regulation, including data protection laws in the jurisdictions where you operate.
• Attempt to reverse engineer, decompile, or extract the source code of the TrackWon platform.
• Use TrackWon to send unsolicited commercial communications.
• Attempt to gain unauthorised access to any part of the TrackWon platform or its underlying infrastructure.
• Use TrackWon to store or transmit malicious code or to interfere with the integrity or performance of the platform.
• Resell, sublicense, or distribute access to TrackWon without our written permission.

We reserve the right to suspend or terminate accounts that violate these acceptable use requirements without notice.

TrackWon is a paid subscription service. Pricing is based on your active pipeline value under management (Revenue Under Management) rather than the number of users. Current pricing is available at trackwon.com/pricing.

Billing. Subscriptions are billed monthly in advance. Payment is processed by Stripe. By subscribing you authorise us to charge your payment method on a recurring basis until you cancel.

Tier changes. If your active pipeline value exceeds your current tier limit, we will notify you and move you to the appropriate tier at your next billing cycle. We will never cut off access mid-month without notice.

Cancellation. You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We do not provide refunds for partial billing periods.

Design partner pricing. If you are on design partner pricing, your discounted rate is locked for the duration of your design partner agreement. The terms of your specific discount are confirmed in writing at the time of onboarding.

Failed payments. If a payment fails we will attempt to notify you. If payment cannot be collected within 7 days of the failed attempt, we may suspend access to your account until payment is resolved.

Our collection and use of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using TrackWon you agree to the Privacy Policy.

You are the data controller. For the purposes of applicable data protection law (including GDPR where applicable), you are the data controller for the personal data of your contacts that is processed through TrackWon. TrackWon acts as a data processor on your behalf.

Your responsibilities. You are responsible for ensuring that your use of TrackWon complies with applicable data protection laws in the jurisdictions where you operate. This includes having a lawful basis for processing the personal data of your contacts and providing appropriate notice to those contacts where required.

Data deletion. When you close your account or request deletion, we will delete all your data including Google-sourced signal data, Journey records, and AI-generated outputs within 30 days.

TrackWon's IP. The TrackWon platform, including its software, design, algorithms, prompt architecture, signal processing logic, and all related intellectual property, is owned by Cloudhubibi FZE. Nothing in these Terms grants you any rights to TrackWon's intellectual property beyond the right to use the platform as a subscriber.

Your data. You retain all rights to the data you bring into TrackWon, including your email and calendar content. TrackWon does not claim ownership of your data.

Feedback. If you provide feedback, suggestions, or ideas about TrackWon, you grant us a perpetual, royalty-free licence to use that feedback to improve the product. You are not entitled to compensation for feedback you provide.

TrackWon uses artificial intelligence to generate Priority Moves, Journey Intelligence summaries, deal risk assessments, and other outputs. These outputs are recommendations to assist your decision-making. They are not guarantees, legal advice, financial advice, or professional recommendations of any kind.

AI outputs are based on the signals TrackWon detects from your Gmail and Calendar activity. The quality of outputs depends on the quality and completeness of the signal data available. When signal data is absent or limited, TrackWon will indicate this rather than fabricate information.

You are responsible for all decisions and actions you take based on TrackWon's outputs. TrackWon is not liable for outcomes resulting from your reliance on AI-generated recommendations.

Service availability. TrackWon is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free service. We will use commercially reasonable efforts to maintain availability but we are not liable for downtime or service interruptions.

No warranty. To the maximum extent permitted by applicable law, TrackWon makes no warranties, express or implied, regarding the platform, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of liability. To the maximum extent permitted by applicable law, TrackWon's total liability to you for any claims arising from or related to these Terms or your use of the platform shall not exceed the amount you paid to TrackWon in the 12 months preceding the claim.

TrackWon is not liable for any indirect, incidental, consequential, special, or punitive damages, including loss of revenue, loss of data, or loss of business opportunities, even if we have been advised of the possibility of such damages.

By you. You may cancel your subscription at any time from within your account settings or by contacting us at fahim.latif@trackwon.com. Cancellation takes effect at the end of your current billing period.

By us. We may suspend or terminate your account immediately if you breach these Terms, if you fail to pay your subscription fees, or if we are required to do so by law. We will provide notice where reasonably practicable.

Effect of termination. On termination, your right to access and use TrackWon ceases immediately. We will delete your data within 30 days of termination unless you request earlier deletion or we are required by law to retain it longer.

These Terms are governed by the laws of the Dubai International Financial Centre (DIFC) in the United Arab Emirates. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the DIFC Courts, except where applicable consumer protection law in your jurisdiction provides otherwise.

If you are based in the UK or EU, mandatory consumer protection laws in your jurisdiction may provide you with additional rights that these Terms do not limit.

We may update these Terms from time to time. When we make material changes, we will notify you by email at least 30 days before the changes take effect and update the "Last updated" date at the top of this page.

Your continued use of TrackWon after the effective date of updated Terms constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using TrackWon before the effective date.
